3. No Guarantee of Results
3pixIQ does not guarantee revenue, rankings, lead volume, advertising outcomes, or business growth.
Results depend on market conditions, competition, budget, and client participation.
4. Client Responsibilities
Clients agree to:
Provide accurate information
Obtain proper consent from their customers
Review deliverables promptly
Make payments on time
Comply with applicable laws
5. Payment & Refund Policy
All deposits are non-refundable once work begins.
Subscription services renew automatically unless canceled in writing.
No refunds are issued for partial billing cycles.
Advertising spend paid to third-party platforms is non-refundable.
Custom development, branding, and CRM setups are non-refundable once delivered or implemented.
6. SMS & Electronic Communications
By providing a phone number, you consent to receive:
SMS messages
Automated reminders
Service notifications
Marketing communications
Message frequency may vary.
You may opt out at any time by replying STOP.
Message and data rates may apply.
Clients using our CRM systems are responsible for obtaining lawful consent from their own customers in compliance with TCPA (USA) and applicable Mexican regulations.
7. Intellectual Property
All materials remain property of 3pixIQ until full payment is received.
Upon full payment, approved deliverables are transferred to the client.
3pixIQ retains the right to showcase work in its portfolio unless otherwise agreed.
8. Limitation of Liability
3pixIQ shall not be liable for:
Indirect damages
Loss of profits
Data loss
Platform penalties
Liability shall not exceed the amount paid for the service in dispute.
9. Arbitration & Dispute Resolution
Disputes shall first be resolved in good faith.
If unresolved:
For U.S. clients – Arbitration in Texas under applicable state law.
For Mexico-based services – Resolution under applicable federal commercial laws.
Clients waive participation in class actions.
Claims must be filed within one (1) year of occurrence.
10. Governing Law
These Terms are governed by:
The laws of the State of Texas (U.S. operations)
Applicable federal laws of Mexico (Mexico operations)
11. Modifications
We reserve the right to modify these Terms at any time.
Continued use constitutes acceptance.
